Congratulations to Attorney Steve McGaver for being named by the Wisconsin Law Journal as one of its Up and Coming Lawyers for 2010. He will be honored at a reception for all of the lawyers on August 31, 2010 at the Wisconsin Club.

Attorney Patrick Knight recently spoke at a health law seminar entitled “A GPS For Health Law” which was presented by the Wisconsin Medical Society’s Office of General Counsel and the Health Law Section of the State Bar of Wisconsin. Attorney Knight moderated a panel of attorneys in a discussion on the "Risks and Pitfalls of Prescribing Controlled Substances."
Attorney Steven McGaver recently commented in the Wisconsin Law Journal on some potential safeguards for attorneys as the use of mobile communication devices and cellular phones continue to rise within the practice.

Attorney Steven McGaver has been installed as the Milwaukee Young Lawyer's Association President. He will serve as president for the next calendar year. He continues the tradition of Gimbel, Reilly, Guerin & Brown's involvement with the Milwaukee Young Lawyer's Association. Attorney Christopher Strohbehn has moved on from his position as Past-President to a member of the Board of Directors of the Association.
Ray Dall’Osto states in a January 2010 Wisconsin Law Journal article that lawyers need to assess photograph and computer image evidence in the digital age with a much more careful and skeptical eye. “I always ask in discovery for mirror images of the hard drives so an independent expert can review the purported illegal images,” he said. “Not only as to when, from where and how downloaded, last modified and last accessed, but also for indicia of alteration, computer generated images and morphing.” To view the full article on the importance of verifying computer and photo image evidence, click here.
Attorney Patrick Knight was recently quoted in the Wisconsin Law Journal discussing the impact of the new changes to the Health Insurance Portability and Accountability Act were passed under the HITECH (Health Information Technology for Economic and Clinical Health) Act as part of the economic stimulus legislation last year. Attorney Raymond Dall'Osto spoke to Wisconsin attorneys at two continuing legal education (CLE) programs in December 2009.
On December 5, 2009, Attorney Dall'Osto presented a lecture at the 30th Annual Conference on Recent Developments in Criminal Law at the Marquette University Law School in Milwaukee, Wisconsin, entitled “Auto Searches and the Impact of Arizona v. Gant”. In Arizona v. Gant, 556 U.S. __, 129 S.Ct. 1710, 173 L.Ed.2d 485 (2009), the United States Supreme Court held that police may search the passenger compartment of a motor vehicle incident to a recent occupant's arrest only if it is reasonable to believe that the arrestee might access the vehicle at the time of the search or that the vehicle contains evidence of the offense of arrest. The Court split 5-4 in rendering the Gant decision, in an unusual line-up. Attorney Dall’Osto noted that Gant appropriately limits the broad rule established in New York v. Belton, 453 U.S. 454 (1981), wherein the Court had held that when a policeman has made a lawful custodial arrest of the occupant of an automobile, s/he may, as contemporaneous and incident to that arrest, enter and search the passenger compartment of the vehicle. The Gant majority observed that the Belton exception to the Fourth Amendment has been greatly expanded and abused in the field over the past several decades. The Gant decision turns the clock back to pre-Belton days, and resurrected the “within reaching-distance rule” of Chimel v. California, 395 U.S. 752 (1969), which better protects the Fourth Amendment rights of everyone who drives or is a passenger in a motor vehicle. Read More...
On December 12, 2009, Attorney Dall'Osto presented a lecture at the Wisconsin Association of Criminal Defense Lawyers Annual Seminar in Madison, Wisconsin, entitled “Swinging the Sword of Justice – Ethically and Effectively”. The crucial importance of criminal defense counsel to fairness in our justice system was stressed by him. Attorney Dall’Osto then joined a panel of presenters, including UW-Law School Prof. Michele LaVigne, Kentucky Public Advocate Atty. Jeremy Rogers, State Bar Ethics Counsel Tim Pierce and Ed Burnette of Chicago, who is chairman of the national Council of Chief Defenders. The panel addressed the continuing ethical problems inherent with low budgets for indigent defense, unrealistically high caseloads for staff public defenders, and extremely low pay for private bar attorneys appointed to represent indigent criminal defendants. The panel interacted with the audience on the legal and political action needed to address such and brain-stormed possible strategies. Read More...
Attorney Christopher Strohbehn was recently recognized on the front page of the December 4, 2009 issue of the Wisconsin Law Journal discussing the benefits of granting Continuing Legal Education (CLE) credits for lawyers attending seminars focusing on practice management areas such as time management, billing and ethics.

Attorney Christopher Strohbehn was published in the Milwaukee Bar Association's Messenger for the Fall of 2009-2010, Volume 3. Attorney Strohbehn wrote an article on the new mandatory automobile insurance law in Wisconsin titled "Mandatory Automobile Insurance: Enhancing a Driver's Responsibility".
